Terms of Service

Welcome to Pull Theory ("the App"), operated by Luke Wertz ("we," "us," or "our").

By creating an account, accessing, or using the App, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of the Service

The App allows users to log, track, analyze, and manage espresso brewing information, including but not limited to espresso dose, output weight, grind settings, tasting notes, beans, and related brewing metadata.

The App may provide informational suggestions or insights based on user-entered data. These suggestions are provided for informational and experimental purposes only.

2. Eligibility

You must be at least 13 years old to use the App.

By using the App, you represent that:

  • you are legally capable of entering into a binding agreement; and
  • your use of the App complies with applicable laws.

3. Accounts

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • all activity occurring under your account; and
  • ensuring your account information remains accurate.

You may not:

  • impersonate another person;
  • share accounts in a misleading or abusive manner; or
  • use the App for unlawful purposes.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Certain features may require a paid subscription.

Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective billing terms and policies.

Subscriptions automatically renew unless canceled before the renewal date through your app store account settings.

We do not directly store or process payment card information.

Pricing may change in the future. Any pricing changes will apply prospectively.

5. User Content

You retain ownership of the content and data you submit to the App, including brewing logs, tasting notes, and related information ("User Content").

You grant us a limited license to store, process, and display your User Content solely for the purpose of operating and improving the App.

You are responsible for ensuring your User Content does not:

  • violate laws;
  • infringe intellectual property rights; or
  • contain malicious code or harmful material.

6. Acceptable Use

You agree not to:

  • reverse engineer or attempt to extract source code from the App;
  • interfere with platform security or infrastructure;
  • use automated systems to abuse the service;
  • attempt unauthorized access to other user accounts or data; or
  • use the App in a manner that could damage or impair the service.

7. Analytics and Third-Party Services

We may use third-party service providers to operate portions of the App, including:

  • Supabase (data storage and authentication)
  • RevenueCat (subscription management)
  • Resend (transactional email delivery)
  • analytics providers

These providers may process limited user data necessary to provide their services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

  • uninterrupted availability;
  • accuracy of recommendations or insights;
  • error-free operation; or
  • that the App will improve espresso quality or brewing outcomes.

Your use of the App is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • indirect, incidental, special, consequential, or punitive damages;
  • loss of data;
  • loss of profits;
  • business interruption; or
  • damages arising from your use of or inability to use the App.

Our total liability for any claim related to the App shall not exceed the amount you paid to us in the preceding twelve (12) months.

10. Termination

You may stop using the App at any time.

We may suspend or terminate access if:

  • you violate these Terms;
  • your use creates legal or security risk; or
  • the service is discontinued.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue any portion of the App at any time without liability.

12. Governing Law

These Terms shall be governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time.

Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
